    Extension of Deadline for Submission of Bids
    Re: Procurement of Supply and Installation of the Pokuase Bulk Supply Point (BSP) Substation - Design-Build 
    Bid Ref: 5140400/IFB/CB/07/18

    Following extensive Clarification Responses, which are considered exceptional circumstances, the Employer, at its sole discretion, amend the Bidding Documents to extend the deadline for the submission of Bids in accordance with Clauses 9 and 23 of the Instructions to Bidders (ITB).  

    Accordingly, the deadline for Bid submission is hereby extended from 27th September, 2018 to 11th October, 2018 at 10:00 am local time, to give prospective Bidders reasonable time to submit their Bids.

    The Bid validity period shall still be one hundred and twenty (120) days after the deadline for Bid submission as specified, consistent with ITB Clause 23.1 and accordingly, a Bid Security that expires before 6th March, 2019, a date twenty-eight (28) calendar days after the end of the bid validity period of 8th February, 2019, shall be rejected as non-responsive.

    All rights and obligations of the Employer and Bidders previously subject to the deadline shall hereafter be subject to the deadline as extended.

    Any Bid received by the MiDA after this deadline for the submission of Bids shall be declared late, rejected and returned unopened to the Bidder.

The United States of America, acting through the Millennium Challenge Corporation (“MCC”) and the Republic of Ghana (the “Republic”) have entered into a Millennium Challenge Compact for Millennium Challenge Account assistance to help facilitate poverty reduction through economic growth in Ghana (the “Compact”) in the amount of Four Hundred and Ninety Eight Million, Two Hundred Thousand United States Dollars (US$ 498,200,000) (“MCC Funding”) and Thirty Seven Million, Three Hundred and Sixty Five Thousand United States Dollars (US$37,365,000) (“Republic Funding”).

    2. The Government of Ghana (“GoG”), acting through the Millennium Development Authority (“MiDA” or “MCA Entity”), intends to apply a portion of the MCC Funding to eligible payments under a contract for which this Request for Proposals (“RFP”) is issued. Any payments made by the MCA Entity under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use and distribution of MCC Funding. No party other than the Government and the MCA Entity shall derive any rights from the Compact or have any claim to the proceeds of MCC Funding. The Compact and its related documents can be found on the MCC website (www.mcc.gov) and on the website of the MCA Entity.

    3. The goal of the Compact program is to reduce poverty through economic growth in Ghana. The objectives of the Compact program are to

    (b) increase employment opportunities for men and women; and
    (c) raise earning potential from self-employment and improved outcomes for men and women.

    The Program consists of six (6) projects: (i) the ECG Financial and Operational Turnaround Project; (ii) the NEDCo Financial and Operational Turnaround Project; (iii) the Regulatory Strengthening and Capacity Building Project; (iv) the Access Project; (v) the Power Generation Sector Improvement project; and (vi) the Energy Efficiency and Demand Side Management Project.

    MCC’s assistance will be provided in a manner that responds to constraints to economic growth by aiming to improve the reliability and quality of power in Ghana.

    The Compact Program will be executed over a period of five (5) years upon Entry into Force (EIF) of the Compact. There will be an initial period of Compact Implementation Funding (CIF) to be used by the Government of Ghana and MiDA to facilitate the implementation of the Compact.

The Republic of Ghana (the “Republic”) and the Millennium Challenge Corporation (“MCC”) have entered into a Millennium Challenge Compact for Millennium Challenge Account assistance to help facilitate poverty reduction through economic growth in Ghana (the “Compact”) in the amount of Four Hundred and Ninety Eight Million, Two Hundred Thousand United States Dollars (US$ 498,200,000) (“MCC Funding”) and Thirty Seven Million, Three Hundred and Sixty Five Thousand United States Dollars (US$37,365,000) (“Republic Funding”). The Government of Ghana (“GoG”), acting through the Millennium Development Authority (“MiDA” or “MCA Entity”), intends to apply a portion of the MCC Funding to eligible payments under a contract for which the Request for Proposals is issued. Any payments made under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use of MCC funding and conditions to the disbursements of MCC funding. No party other than the Government of Ghana and MiDA shall derive any rights from the Compact or have any claim to the proceeds of MCC Funding.

Bid Challenge System (BCS)

BACKGROUND
On 5th August 2014 the United States of America, acting through the Millennium Challenge Corporation, and the Republic of Ghana (the “Republic”) signed a Millennium Challenge Compact pursuant to which MCC agreed to provide a grant of up to $ 498,200,000 to the Government for a program to reduce poverty through economic growth in Ghana. In addition, the Republic of Ghana has provided funding of $37,365,000. The Government has designated the Millennium Development Authority (“MiDA”), Ghana, to oversee and implement the compact program in accordance with the terms of the Compact. The Compact requires the Government (including any designee) to ensure that it procures all goods, works and services to implement the compact program in accordance with the MCC Program Procurement Guidelines. The MCC Program Procurement Guidelines further require that MiDA establish and publish a Bid Challenge System that provides Bidders on MiDA procurements with the ability to challenge and seek review of MiDA procurement actions and decisions.

To comply with these requirements, MiDA has established the rules and procedures set forth in this document, also referred to as its Bid Challenge System or BCS, to govern the review of all challenged MiDA procurement actions and decisions, and which will be incorporated in all solicitation documents distributed to potential Bidders.

    NOTICE OF BID CHALLENGE 
    LEVEL 1 AUTHORITY DECISION

    Procurement for the  
    SUPPLY AND INSTALLATION OF THE KASOA BULK SUPPLY POINT (BSP) SUBSTATION-Design-Build
    CB No: 5140400-05/IFB/CB/06/19

    In accordance with Rule 2.1.2 (b) of the MiDA Bid Challenge System, notice is hereby given to all Bidders that the Protest from Larsen & Toubro (L&T) Construction Limited has been upheld, and that the decision is to re-convene the Bid Review Panel and request them to re-evaluate the Larsen & Toubro (L&T) Construction Limited Bid in light of the issues raised in their Protest.

    If Larsen & Toubro (L&T) Construction Limited are dissatisfied with the decision of the Level 1 Authority then they may seek review of that decision by filing an Appeal to the Level 2 Authority in accordance with Rule 3 of the MiDA Bid Challenge System.

    Please note that, in accordance with Rule 3.2.3 the Challenger must pay an Appeal Fee of US$ 2,500 (Two Thousand Five Hundred United States Dollars only) before or at the time it files the Appeal by depositing the same to MiDA.

    In accordance with Rule 3.2.1 of the Bid Challenge System, an Appeal must be filed with the Secretariat no later than 17:00 hours (local time in Ghana) on or before Thursday, 21st November, 2019 in order to be considered as timely Filed.

    In accordance with Rule 1.7 (c) and 1.7 (e)  of the Bid Challenge System the Level 1 Authority hereby maintains the lifted suspension of the Procurement.

    NOTICE OF BID CHALLENGE
    PROCUREMENT FOR THE
    SUPPLY AND INSTALLATION OF THE KASOA BULK SUPPLY POINT (BSP) SUBSTATION – DESIGN-BUILD

    CB No: 5140400-05/IFB/CB/06/19

    In accordance with Rule 1.5 of the MiDA Bid Challenge System notice is hereby given that a Protest has been received from Larson & Toubro Limited.

    The Protest indicates that:
    •    The Procurement Rules provisions violated by the Procurement action were the MCC Procurement Guidelines P1.A.2.61. 
    •    In the Examination of the Technical Bid, we have noted certain observations which are detailed in Annexure I enclosed. 

    In accordance with Rule 1.6 of the MiDA Bid Challenge System, all Bidders are hereby advised that they are able to file a Comment and that failure to file a Comment in the required time period will prevent any future participation in the Protest.

    In line with Rule 1.7 of the MiDA Bid Challenge System, the Level 1 Authority lifts the suspension on the Challenged Procurement after determining the following:
    (i)    as per Rule 1.7 (c) MiDA or Bidders other than the Challenger may sustain disproportionately greater harm by the suspension, compared to the harm to be possibly sustained by the Challenger; and 
    (ii)    as per Rule 1.7 (e) there are urgent or compelling reasons not to suspend the Challenged Procurement, including potential harm to MiDA.
    In accordance with the principle enshrined in Rule 1.8 of the MiDA Bid Challenge System, MiDA will ensure that the Challenger’s potential remedies are not compromised should the Protest be upheld.

  • NOTICE OF LEVEL 1 AUTHORITY DECISION - BID CHALLENGE RE:PROCUREMENT FOR SUPPLY & INSTALLATION OF THE PRIMARY SUBSTATIONS INTERCONNECTING CIRCUITS

    NOTICE OF BID CHALLENGE
    LEVEL 1 AUTHORITY DECISION

    Procurement for the
    Supply and Installation of the Primary Substations Interconnecting Circuits for Korle-Gonno, Kotobabi, Kanda and Legon Lot 1 and 2
    CB No: 5940500/IFB/CB/06/19

    In accordance with Rule 2.4 of the MiDA Bid Challenge System, notice is hereby given to all Bidders that the Protests from Process & Plant Automation Limited, JV Alpha TND Limited and Capital Electech Private Limited, and CEGELEC have been upheld, and that the decision is to re-convene the Bid Review Panel and request them to re-evaluate all of the Bids submitted, for Lot 1 and Lot 2, in light of the various issues raised in the Protests.

    At the end of the process, the revised Bid Review Report will be submitted to MiDA Management for approval and, subsequently, to MCC for their No Objection. All Bidders will be informed of the result in accordance with the provisions of the MCC Program Procurement Guidelines and the bidding documents.

    If any of Process & Plant Automation Limited, JV Alpha TND Limited and Capital Electech Private Limited, and CEGELEC are dissatisfied with the decision of the Level 1 Authority then they may seek review of that decision by filing an Appeal to the Level 2 Authority in accordance with Rule 3 of the MiDA Bid Challenge System. Please note that, in accordance with Rule 3.2.3 the Challenger must pay an Appeal Fee of US$ 2,500 (Two Thousand Five Hundred United States Dollars only) before or at the time it files the Appeal by depositing the same to MiDA.In accordance with Rule 3.2.1 of the Bid Challenge System, an Appeal must be filed with the Secretariat no later than 17:00 hours (local time in Ghana) on or before Thursday, November 7th, 2019 in order to be considered as timely Filed.

    The Protest indicates that:
    •    General Conditions of MCC Procurement Guidelines: P1.A.1.2(a) Open fair, and competitive procedures shall be used in a transparent manner to solicit, award, and administer contracts to procure goods, works and non-consulting services.
    •    Criteria and sub-criteria and points system for the evaluation of technical offers stated in ITB 29.1particularly in the following criteria: 2.1 Proposed overall approach and methodology; 2.2 Proposed work plan, including health and safety social and environment management plan etc; 3.2 Proposed key personnel.

    In accordance with Rule 1.6 of the MiDA Bid Challenge System, all Bidders are hereby advised that they are able to file a Comment and that failure to file a Comment in the required time period will prevent any future participation in the Protest.

    •    Bid Review, technical evaluation and scoring was unfair, arbitrary, capricious and characterized by an abuse of discretion and failure to consider the clarifications issued during the Bidding process.
    •    Technical scoring was inaccurate, included a number of omissions and oversight and not in compliance with the stipulations of the evaluation criteria as specified in Section III of the Bidding Document (5940500/IFB/CB/06/19)

    In accordance with Rule 1.6 of the MiDA Bid Challenge System, all Bidders are hereby advised that they are able to file a Comment and that failure to file a Comment in the required time period will prevent any future participation in the Protest.

  • PROFILE OF THE INDEPENDENT REVIEW PANEL

    INDEPENDENT REVIEW PANEL

    The Independent Review Panel (IRP) is a 6 member panel inaugurated on March 1st 2017.

    The role of the IRP is to review decisions of the Level 1 Authority where an appeal is filed; This Body also has the mandate to uphold or overturn a level 1 Authority decision upon review of an Appeal. Its scope includes:

    1.The authority to require the MCA Entity (MiDA) to revise the procurement proceedings to conform to the applicable guidelines.

    2.Suspend the procurement in order to preserve the commercial opportunity pending the outcome of the review,

    3.Terminate the procurement, order a new procurement, or

    4. Require the MCA Entity to compensate a successful challenger for loss or damage suffered to the extent of the cost of preparation of the bid challenge. Anticipated profits may not be recovered.

    IRP is independent and impartial, competent and have an understanding of MCC procurement rules, practices and procedures.
