    1. There has been a change in the scope of the assignment because certain parts of the scope are being implemented by the Government of Ghana.

    2. MiDA is looking at other alternative strategies for implementing the assignment in a more cost-effective manner.

    1. The United States of America, acting through the Millennium Challenge Corporation (“MCC”) and the Republic of Ghana (the “Republic”) have entered into a Millennium Challenge Compact for Millennium Challenge Account assistance to help facilitate poverty reduction through economic growth in Ghana (the “Compact”) in the amount of Four Hundred and Ninety Eight Million, Two Hundred Thousand United States Dollars (US$ 498,200,000) (“MCC Funding”) and Thirty Seven Million, Three Hundred and Sixty Five Thousand United States Dollars (US$37,365,000) (“Republic Funding”).

    2. The Government of Ghana (“GoG”), acting through the Millennium Development Authority (“MiDA” or “MCA Entity”), intends to apply a portion of the MCC Funding to eligible payments under a contract for which this Request for Proposals (“RFP”) is issued. Any payments made by the MCA Entity under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use and distribution of MCC Funding. No party other than the Government and the MCA Entity shall derive any rights from the Compact or have any claim to the proceeds of MCC Funding. The Compact and its related documents can be found on the MCC website (www.mcc.gov) and on the website of the MCA Entity.

    3. The goal of the Compact program is to reduce poverty through economic growth in Ghana. The objectives of the Compact program are to
    (a) Increase private sector investment and productivity and profitability of micro, small, medium and large scale businesses;
    (b) increase employment opportunities for men and women; and
    (c) raise earning potential from self-employment and improved outcomes for men and women.

    The Program consists of six (6) projects: (i) the ECG Financial and Operational Turnaround Project; (ii) the NEDCo Financial and Operational Turnaround Project; (iii) the Regulatory Strengthening and Capacity Building Project; (iv) the Access Project; (v) the Power Generation Sector Improvement project; and (vi) the Energy Efficiency and Demand Side Management Project.

    MCC’s assistance will be provided in a manner that responds to constraints to economic growth by aiming to improve the reliability and quality of power in Ghana.

    The Compact Program will be executed over a period of five (5) years upon Entry into Force (EIF) of the Compact. There will be an initial period of Compact Implementation Funding (CIF) to be used by the Government of Ghana and MiDA to facilitate the implementation of the Compact.

    4.     10. Prospective Consultants interested in submitting a Proposal should send an e-mail, giving full contact details of the Consultant, to the MiDA Procurement Agent at paghana@charleskendall.com. This will ensure that the Consultants receive updates regarding this RFP. Before applying, interested consultants should review the Terms of Reference, which are in the Request for Proposals (RFP) Document.  The RFP will be issued on application to the MiDA Procurement Agent, Millennium Development Authority, 3rd Floor, Heritage Tower, 6th Avenue, Ridge West, Accra, Ghana, at paghana@charleskendall.com.

    The Republic of Ghana (the “Republic” or “GoG”) and the Millennium Challenge Corporation (“MCC”) have entered into a Millennium Challenge Compact for assistance to help facilitate poverty reduction through economic growth in Ghana (the “Compact”) in the amount of Four Hundred and Ninety Eight Million, Two Hundred Thousand United States Dollars (US$ 498,200,000) (“MCC Funding”) and Thirty Seven Million, Three Hundred and Sixty Five Thousand United States Dollars (“GoG Funding”). The Government of Ghana, acting through the Millennium Development Authority (“MiDA”), intends to apply a portion of the MCC Funding to eligible payments under a contract for which the Request for Proposals is issued. Any payments made under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use of MCC funding and conditions to the disbursements of MCC funding. No party other than the Government and MiDA shall derive any rights from the Compact or have any claim to the proceeds of MCC Funding.

    The goal of the Compact program is to reduce poverty through economic growth in Ghana. The objectives of the Compact program are to:

    1. Increase private sector investment and productivity and profitability of micro, small, medium and large scale businesses;
    2. increase employment opportunities for men and women; and
    3. raise earning potential from self employment and improved outcomes for men and women.

    The Program consists of six (6) projects:

    1. the ECG Financial and Operational Turnaround Project;
    2. the NEDCo Financial and Operational Turnaround Project;
    3. the Regulatory Strengthening and Capacity Building Project;
    4. the Access Project;
    5. the Power Generation Sector Improvement project; and
    6. the Energy Efficiency and Demand Side Management Project.

    MCC’s assistance will be provided in a manner that responds to constraints to economic growth by aiming to improve the reliability and quality of power in Ghana. The Compact Program will be executed over a period of five (5) years upon Entry into Force (EIF) of the Compact. There will be an initial period of Compact Implementation Funding (CIF) of 8-10 months to be used by Government and MiDA to facilitate the implementation of the Compact.

    This Invitation for Proposals follows the General Procurement Notice that appeared in dgMarket on 3 September, 2015, UNDB Online on 3 September, 2015, the MiDA websitewww.mida.gov.gh, and in the local media.

    This Letter of Invitation (LOI) is an extension of the original Specific Procurement Notice/LOI issued on 11 September 2015 and remains open to all eligible individual Consultants.

    The Terms and Conditions of the Letter of Invitation and Terms of Reference for this activity have been clarified in order to enable all interested Individual Consultants to comply with the required documentation and requirements for this activity.

Bid Challenge System (BCS)

BACKGROUND
On 5th August 2014 the United States of America, acting through the Millennium Challenge Corporation, and the Republic of Ghana (the “Republic”) signed a Millennium Challenge Compact pursuant to which MCC agreed to provide a grant of up to $ 498,200,000 to the Government for a program to reduce poverty through economic growth in Ghana. In addition, the Republic of Ghana has provided funding of $37,365,000. The Government has designated the Millennium Development Authority (“MiDA”), Ghana, to oversee and implement the compact program in accordance with the terms of the Compact. The Compact requires the Government (including any designee) to ensure that it procures all goods, works and services to implement the compact program in accordance with the MCC Program Procurement Guidelines. The MCC Program Procurement Guidelines further require that MiDA establish and publish a Bid Challenge System that provides Bidders on MiDA procurements with the ability to challenge and seek review of MiDA procurement actions and decisions.

To comply with these requirements, MiDA has established the rules and procedures set forth in this document, also referred to as its Bid Challenge System or BCS, to govern the review of all challenged MiDA procurement actions and decisions, and which will be incorporated in all solicitation documents distributed to potential Bidders.

    The Appeal indicates that the Decision taken by the Level 1 Authority was arbitrary or capricious or characterised by an abuse of discretion.

    In accordance with Rule 3.5 of the MiDA Bid Challenge System, all Bidders who commented on the Bid Challenge Protest are hereby advised that they are able to file a Comment and that failure to file a Comment in the required time period will prevent any future participation in the Appeal.

  • Profile of the Independent Review Panel

     INDEPENDENT REVIEW PANEL

    The Independent Review Panel (IRP) is a 6 member panel inaugurated on March 1st 2017.

    The role of the IRP is to review decisions of the Level 1 Authority where an appeal is filed; This Body also has the mandate to uphold or overturn a level 1 Authority decision upon review of an Appeal. Its scope includes:

    1.The authority to require the MCA Entity (MiDA) to revise the procurement proceedings to conform to the applicable guidelines.

    2.Suspend the procurement in order to preserve the commercial opportunity pending the outcome of the review,

    3.Terminate the procurement, order a new procurement, or

    4. Require the MCA Entity to compensate a successful challenger for loss or damage suffered to the extent of the cost of preparation of the bid challenge. Anticipated profits may not be recovered.

    IRP is independent and impartial, competent and have an understanding of MCC procurement rules, practices and procedures.
